NATIONAL LIST OF SPECIES OF AQUATIC INVERTEBRATES AND FISH IN DANGER OF EXTINCTION
The SAA Study Group are interested in and affected by the laws, rules and regulations concerning the trade and conservation of South American Annual Fish. The plight of the fish we keep has not been recognised until now by CITES. This has allowed the hobbyist freedom of movement of SAA eggs and fish between countries. By far the largest threat to the SAA species is from habitat destruction by man. Any attempts at conservation will fail if the South American countries do not preserve the habitats of the fish.

Unfortunately, government measures and laws introduced to help conserve species can have the opposite effect to that intended, and will affect the SAA Group by outlawing the capture and keeping of some of these "pearls" of South America. The list is striking in the species missing from the list as well as those included and their supposed "categorisation".

The SAA Group may need to take some form of action. Perhaps the group will need to demonstrate some serious actions and commitment to conservation in order to allow us to continue keeping the Brazilian species. The only way forward may be to cooperate with government institutions and scientific establishments.

Does the SAA Group have a compelling case to persuade these groups to cooperate... ?

INSTRUÇÃO NORMATIVA Nº 5, of 21st May 2004
     The MINISTER OF STATE for The Environment, in use of its legal attributions, in applying art. 27, § 6o, of the Law no 10.683, of 28th May 2003, and Considering the commitments assumed for Brazil in the Convention on Biológica-CDB Diversity, ratified for the Legislative Decree no 2, of 8th February 1994 and promulgated for the Decree no 2.519, of 16th March 1998, particularly those explicitly in no art 7, lines b and b; 8, lines f; 9, line c, and 14 in the Convention on the International trade of the Species of Wild Flora and Fauna in Danger of Extinction (Comércio Internacional das Espécies da Flora e Fauna Selvagens em Perigo de Extinção - CITES), ratified by the Legislative Decree no 54, of the 24th June 1975 and promulgated by the Decree no 92.446, of the 7th March 1986; In consideration of disposition of Law nos 5.197, of the 3rd January 1967 and 9.605, of the 12th February 1998, and Decree no 3.179, of the 21st September 1999; and in consideration of the principal directives for the implementation of the National Policy of Biodiversity, consistent with the Decree no 4.339, of 22nd August 2002, decides:

Art. 1 To recognize as species threatened with extinction and over-exploitation or species threatened with over-exploitation, aquatic invertebrates and fish, contained in the Appendices of this Normative Instruction.
Art. 2 It is understood for these species: I - threatened with extinction: those with high risk of disappearance in nature in the near future, as recognized by the Ministry of the Environment; II - over-exploited: those whose condition of capture of one or all the stages of development in a population are so high that it reduces the biomass, the potential of spawning of fishes and their capture in the future, to a lower level than is secure; III - threatened with over-exploitation: those whose level of explotation is near to one of over-exploitation.
Art. 3 The species considered as threatened of extinction in the contents of Appendix 1 of this Normative Instruction are forbidden to be captured, in the terms of the legislation immediately, except for scientific purposes, by means of special authorization of the Instituto Brasileiro do Meio Ambiente (Brazilian Institute of the Environment) and Recursos Naturais Renováveis-IBAMA (Renewable Natural Resources-IBAMA).
Art. 4 To stop the species considered as threatened of extinction in the contents of Appendix 1 of this Normative Instruction, a plan of recovery will have to be developed that will be elaborated and implemented under the coordination of Instituto Brasileiro do Meio Ambiente and Recursos Naturais Renováveis-IBAMA with the participation of the state agencies, of the scientific community and the civil organisations, in a maximum stated period of five years, from the publication of this Normative Instruction.
Art. 5 For the over-exploited or species threatened with over-exploitation contained in Appendix II of the Normative Instruction, a plan of management will have to be developed, under the coordination of the Instituto Brasileiro do Meio Ambiente and Recursos Naturais Renováveis-IBAMA, with the participation of the state agencies, the scientific community and the civil organisation, , in a maximum stated period of five years, from the publication of this Normative Instruction. Only paragraph. The management plans aim to recover the supplies and of the sustainability of the fish, without damaging the improvement made by the existing measures.
Art. 6 The list contained in the Appendices I and II of this Normative Instruction will be revised on the basis of criteria and procedures as defined by the Work Group on Breeding for Portaria no 231, of the 26th May 2003.
Art. 7 In observance of this Normative Instruction the infringer will be subject to the penalties and sanctions proposed in the specific legislation.
Art. 8 This Normative Instruction is immediately in force from the date of its publication.
